Terms of Service

These Terms of Service (“Terms”) are an agreement between HueOfMe, Inc., a Delaware corporation doing business from Arizona (“HueOfMe,” “we,” “us,” or “our”), and you (“you,” “your,” or “user”). By accessing or using our website, marketplace, and related services (the “Platform” or “Services”), you agree to these Terms.
1) Definitions
- Platform: the HueOfMe website, applications, and related services.
- Client: an individual or entity who books and pays for beauty services via the Platform.
- Technician: an independent beauty professional offering services on the Platform.
- Booking: a confirmed reservation for a service.
- Fee: the amount retained by HueOfMe for facilitating a Booking.
- Account: a registered user profile on the Platform.
2) Platform Role
HueOfMe is an online marketplace. We do not provide beauty services and do not employ Technicians. Technicians act as independent contractors solely responsible for licensing, insurance, safety, and service quality.
3) User Conduct
You must comply with applicable laws and treat other users respectfully. Harassment, discrimination, fraud, or illegal conduct may result in suspension or termination of your Account.
4) Accounts
You are responsible for your Account credentials and all activity under your Account. Notify us promptly of unauthorized use.
5) Bookings, Payments & Fees
Marketplace listings, pricing, and payment methods are presented in-app. Taxes/fees may apply. Payments are processed by third-party processors (e.g., Stripe). If you confirm a Booking, you agree to HueOfMe's platform terms and to any Technician policies displayed on HueOfMe for that Technician, service, or Booking before the Booking is confirmed, including policies shown on the Technician's public profile, service listing, booking page, or other in-platform booking surfaces.
6) Cancellations, No-Shows & Credits
If a Client cancels a Booking less than 24 hours before the scheduled start time, the Client authorizes an automatic, non-refundable Late-Cancellation Fee of USD 20.00, retained by HueOfMe as a platform fee. If the Client fails to appear for the scheduled service (“No-Show”), the Client authorizes an automatic, non-refundable No-Show Fee of USD 50.00, also retained by HueOfMe.
If a Technician cancels a confirmed Booking, HueOfMe will automatically issue the Client 10 platform credits to apply toward a future Platform Booking Fee (credits are not cash and do not apply to a Technician’s service price unless explicitly stated in-app).
7) Technician Policies
Technicians may choose to post appointment-specific policies on HueOfMe, including cancellation windows, late-arrival expectations, no-show expectations, deposit requirements, preparation instructions, service restrictions, location rules, and other service-specific conditions. Technician policies are optional for Technicians to provide, but when a Technician posts policies on HueOfMe, those policies apply to Bookings with that Technician if they are displayed on HueOfMe before the Booking is confirmed.
Clients are responsible for reviewing any Technician policies displayed on the Technician's public profile, service listing, booking page, or other in-platform booking surfaces before confirming a Booking. If a Technician policy conflicts with these Terms or HueOfMe's platform rules, these Terms and HueOfMe's platform rules control unless HueOfMe expressly permits the Technician-specific policy.
8) SMS Program Terms
HueOfMe offers SMS programs related to bookings and account activity. These programs may include transactional SMS for booking alerts and account updates, as well as a separate, optional post-appointment feedback program.
- Booking Alerts & Account Updates: These messages may include booking confirmations, reminders, technician changes, reschedules, rescheduling requests, cancellations, support notices, and other account or appointment-related updates.
- Post-Appointment Feedback: If you separately opt in, HueOfMe may send a post-appointment feedback text so you can leave a 1–5 rating and an optional written review.
- Opt-in: You may opt in during signup, booking, account settings, or through another disclosed consent flow on hueofme.com. If a Technician creates, reschedules, or submits a rescheduling request for a booking on your behalf and no booking-specific SMS preference is collected in that flow, HueOfMe may rely on your then-current SMS consent status on file for booking-related transactional messages and, where applicable, post-appointment feedback messages, unless you have opted out.
- Feedback Consent: Consent to receive post-appointment feedback texts is separate from consent to receive booking alerts and account updates. Consent is optional and is not required to book, receive services, create an account, or complete a transaction.
- Opt-out: Reply STOP to cancel at any time. For help, reply HELP. We honor
STARTandUNSTOPto re-subscribe where supported. - Support: Reply HELP for help or contact support@hueofme.com.
- Frequency: Recurring messages; frequency varies by activity. Booking-related messages typically vary by appointment activity, and feedback requests are sent only when applicable. Message & data rates may apply.
- Carrier disclaimer: Carriers are not liable for delayed or undelivered messages.
- Links: We use first-party links on our own domain (no public URL shorteners).
Our handling of mobile numbers, consent records, and SMS data is described in the Privacy Policy.
9) Intellectual Property
The Platform, including content, logos, and trademarks, is owned by HueOfMe or its licensors and protected by law. No rights are transferred except as expressly stated.
10) Data License & Processing
You grant HueOfMe a worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, and display content and data you upload solely to operate and promote the Platform, improve our products and services, and meet legal requirements. HueOfMe does not “sell” personal data under applicable privacy laws.
11) Disclaimers
The Platform is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12) Limitation of Liability & Release
To the maximum extent permitted by law, HueOfMe is not liable for any indirect, incidental, special, consequential, or punitive damages, or for injuries or damages occurring before, during, or after services arranged via the Platform. You release HueOfMe from claims arising out of interactions between Clients and Technicians. This does not limit liability for gross negligence or willful misconduct.
13) Indemnification
You agree to indemnify and hold HueOfMe harmless from claims, damages, and expenses arising out of your breach of these Terms or your interactions with other users.
14) Changes to the Terms
We may amend these Terms at any time. Revised Terms take effect immediately for new users and 30 days after posting for existing users. Continued use after the effective date constitutes acceptance.
15) Governing Law & Venue
These Terms are governed by the laws of the State of Arizona, USA. All disputes shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction therein.
16) Severability
If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
